ResMed is committed to protecting the privacy and security of your personal data.     Under certain laws we are required to state the legal basis for processing your personal data and any special categories of personal data. We process your personal data on the legal basis that processing is required to meet the Service contract and for our legitimate interests to improve our product and services. We rely on your consent to process any health data that is classified as a special category of personal data and for marketing purposes.

Privacy Notice for California Residents

This Privacy Notice for California residents supplements the information contained inResMed’s S+ privacy policy and applies solely to all visitors, users, and others who reside in the State of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (CCPA), including the Attorney General regulations proposed in 2019, and any terms defined in the CCPA have the same meaning when used in this notice.

Information We Collect

ResMed collects information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“personal information”). In particular, ResMed has collected (or not collected, if indicated below) the following categories of personal information from its consumers within the last twelve (12) months:

A real name, unique personal identifier, online identifier, Internet Protocol address, email address, account name, or other similar identifiers.


B. Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)).

A name, signature, telephone number, education, or medical information. Some personal information included in this category may overlap with other categories.


C. Protected classification characteristics under California or federal law.

Age, medical condition, physical or mental disability, and gender.


D. Commercial information.

Records of products or services purchased, obtained, or considered.


E. Biometric information.

Genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information, such as sleep, health, or exercise data.


F. Internet or other similar network activity.

Browsing history, search history, information on a consumer’s interaction with a website, application, or advertisement.


G. Geolocation data.

Physical location or movements.


H. Sensory data.

Audio, electronic, visual, thermal, olfactory, or similar information.


I. Professional or employment-related information.

Current or past job history or performance evaluations.


J. Non-public education information (per the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part 99)).

Education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records.

Disclosure Rights

You have the right to request that we disclose the categories of personal information we collect in the preceding 12-month period prior to the request date. Consumer requests of this nature may be made no more than twice in a 12-month period.

You have the right to request that ResMed disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your consumer request (see section on Exercising Your Data Rights), we will disclose to you:

Any disclosures we provide will only cover the 12-month period preceding the consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data access requests, we will deliver the data in a readily, useable format.

California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We do not knowingly collect personal data from children. The content of our Service is not intended for, or directed to, children. If you are under 13 years of ageor otherwise considered a minor under the laws of your country of residence, please do not use or access our Service at any time or in any manner.If a parent or legal guardian becomes aware that their child has provided us with personal data, please contact us by sending an email to privacy@resmed.com. If we confirm that a user is a minor and has provided us with their personal data, we will delete their information from our databases.

We may update this Privacy Notice from time to time. We encourage you to review this Privacy Notice regularly. Each Privacy Notice includes the date on which it was last updated.
